Forestry Regulations, 2026 now in force
New regulations under the Forestry Act set the closed season, protect listed tree species, update royalties and fees, and replace the Forestry Rules.
The Forestry Regulations, 2026 were published in the Malawi Gazette Supplement of 22 May 2026 (Government Notice No. 42). Made by the Minister of Natural Resources under section 86 of the Forestry Act, they replace the Forestry Rules.
What the Regulations cover
Licences. No one may use forest land, or forest produce on customary land, public land, a forest reserve or a protected forest area, without a licence issued under the Act.
Protected trees. Species listed in the First Schedule may not be harvested.
Closed season. Harvesting is prohibited from 1 November to 31 March, except under a special licence.
Village forest areas. Building, grazing, cultivating, cutting, burning or keeping bees in a village forest area needs the written permit of the village natural resources management committee.
Felling and removal. Rules on cutting height, waste, measuring timber, stacking firewood, and removing produce within the licence period.
Royalties and fees. Updated royalties per cubic metre for indigenous and exotic timber, per pole and for fuelwood, and fees for activities in forest reserves.
Contravening the Regulations is an offence carrying a fine of K5,000,000 and imprisonment for ten years.
